The Independent Police Investigative Directorate (IPID) has officially declassified the investigation report into the circumstances surrounding the death of Lieutenant Colonel Charl Kinnear, who was tragically killed outside his home on 18 September 2020. This announcement was made on 6 November 2024.
The report had been classified in 2022 to protect sensitive information, particularly that of witnesses and implicated police officers who had not yet been charged. According to the IPID Act, Section 33(2), information regarding investigations could not be disclosed to any parties other than those directly involved until the charges were determined. This precaution was taken to avoid any potential legal risks.
In a statement, Ms. Dikeledi Ntlatseng, Executive Director of IPID, explained that the decision to declassify the report was influenced by recent developments, including the public release of witness information. With the details now in the public domain, IPID believes the protection of witnesses is no longer at risk.
The investigation uncovered misconduct by several police officers due to their actions or inactions surrounding the case. A total of nine officers were implicated, seven from the South African Police Service (SAPS) and two from the Directorate for Priority Crime Investigation (DPCI). As a result, IPID has made criminal referrals to the National Prosecuting Authority (NPA) and issued disciplinary recommendations to SAPS and DPCI.
SAPS has confirmed that disciplinary processes are underway for the officers involved, as per IPID’s recommendations. Meanwhile, IPID will also consult with the NPA regarding their 2022 decision not to pursue criminal charges.
This marks a significant step in the ongoing pursuit of justice for Detective Kinnear, whose death highlighted serious concerns about police accountability and conduct.
